How the FLC Protects Land

 

We work with interested landowners to develop a conservation outcome that best suits their land and their needs.

A gift of land is a powerful way for someone to leave a lasting impact on the environment and their community. Fallbrook Land Conservancy protects many types of land—such as open spaces, farmland, and historical buildings — in many ways – through fee title ownership, conservation easements, or other deed restrictions. 

Fallbrook Land Conservancy carefully evaluates each potential land donation to determine if it aligns with our goals and vision, and to ensure we have adequate stewardship funds. FLC diligently reviews each potential donation, including title research, access, and encumbrances. We work closely with you to determine your goals and wishes for the property now, and in the future. 

Our work is forever. We may ask for stewardship funding to ensure we can care for the land now, and forever.

There are many ways we can work together to protect the land you love.

GIFTS

An outright gift of land to Fallbrook Land Conservancy through transfer of fee title is often the simplest way to protect the land you love. This gift is tax deductible based on a qualified fair market value appraisal at the time of the gift.

BARGAIN SALE

Like an outright gift, where fee title is ultimately deeded to Fallbrook Land Conservancy, but the donor sells the land below the appraised fair market value. The donor receives some cash, and the value of the donated amount is tax-deductible. 

Fallbrook Land Conservancy must fundraise or find funds through grants to complete the transaction.


CONSERVATION EASEMENTS

Conservation easements enable landowners to protect all or a portion of their land without giving up title to the land, or going through a costly lot-split process.  

These are legal agreements, recorded on the property’s title, that limit development on private land while keeping ownership with the landowner. Conservation Easements help preserve wildlife habitat, open space, and scenic landscapes, ensuring these lands remain protected for future generations.

There may be tax-benefits to gifting a conservation easement. Please consult with your tax attorney or estate planning agent.



AGRICULTURAL EASEMENTS

Like conservation easements, agricultural easements enable landowners to retain ownership while protecting the agricultural values of their land forever. 

These are legal agreements, recorded on the property’s title. The land can still be cultivated and income producing for the property owner. 

There may be tax-benefits to gifting an agricultural easement. Please consult with your tax attorney or estate planning agent.
